Public offer

1.1. This document is the official public offer of Sole proprietor (FOP) Anatolii Plyta (hereinafter — the “Seller”) to conclude a contract for the sale of goods presented in the online store at https://arctica.org.ua, on the terms set out below, in accordance with Articles 633, 641 and 642 of the Civil Code of Ukraine.

1.2. The agreement is public, and its terms are the same for all buyers. Placing an order on the website, by phone or via the Seller’s messengers constitutes full and unconditional acceptance of the terms of this offer by the Buyer.

1.3. By placing an order, the Buyer confirms that they have read the terms of this offer, agree with them and undertake to comply with them.

2.1. The Seller undertakes to transfer into the Buyer’s ownership the goods — drinking water in reusable 18.9 L bottles, coolers, pumps and water accessories (hereinafter — the “Goods”), and the Buyer undertakes to accept the Goods and pay for them on the terms of this agreement.

2.2. The range, characteristics and prices of the Goods are stated on the pages of the online store https://arctica.org.ua. Images of the Goods on the website are illustrative and may differ slightly from their actual appearance.

3.1. Orders are placed by the Buyer independently on the website (via the cart), by the Seller’s phone numbers or via the Telegram and Viber messengers.

3.2. No minimum quantity of Goods is set — you can order from a single 18.9 L bottle. For orders below 360 UAH, as well as for orders of a single bottle regardless of the amount, a delivery fee of 100 UAH applies (clause 5.2).

3.3. After the order is placed, the Seller’s manager contacts the Buyer to confirm the contents of the order, the address, the delivery time and the payment method. The agreement is considered concluded from the moment the order is confirmed.

3.4. The Seller has the right to refuse to fulfil an order if the Goods are unavailable, delivery to the specified address is impossible, or the Buyer has provided incomplete or inaccurate information.

4.1. Prices for the Goods are stated in Ukrainian hryvnias (UAH) and are valid at the moment the order is placed. The Seller has the right to change prices on the website; the price of a confirmed order is not subject to change.

4.2. The Buyer may pay for an order in one of the following ways:

• in cash to the courier upon receipt of the Goods;
• online by bank card via the LiqPay payment service (Visa / Mastercard);
• by bank transfer against an invoice — for legal entities and sole proprietors (by arrangement).

4.3. A one-time deposit of 350 UAH per bottle is paid for the reusable container (18.9 L bottle). The deposit is refunded to the Buyer in full upon return of the container in proper condition.

5.1. Delivery is carried out by the Seller’s own service across Kyiv and the Kyiv region: Kyiv, Brovary, Vyshneve, Irpin.

5.2. Delivery of orders of 360 UAH or more is free of charge. For orders below that amount, as well as for orders containing only one 18.9 L bottle of water (regardless of the total amount including the deposit and related goods), the delivery fee is 100 UAH. Delivery terms for other localities are agreed with the manager individually.

5.3. Delivery is performed within the Seller’s working hours (Mon–Sat: 9:00–19:00) in a time window agreed with the Buyer. The courier calls the Buyer before arrival.

5.4. The risk of accidental damage to the Goods passes to the Buyer from the moment the Goods are handed over.

6.1. The 18.9 L bottles are reusable deposit containers and remain the property of the Seller. On every subsequent delivery, empty bottles are exchanged for full ones. If the cooperation is terminated, the Buyer returns the containers and the Seller refunds the deposit amount for undamaged bottles.

6.2. Claims regarding the quality of the water or the integrity of the packaging are accepted at the moment the Goods are received or within a reasonable time after a defect is discovered. Goods of improper quality are replaced free of charge, or the Buyer is refunded.

6.3. Returns and exchanges of Goods of proper quality (equipment, accessories) are carried out in accordance with the Law of Ukraine “On Protection of Consumer Rights” within 14 days, provided the Goods have not been used and their merchantable condition has been preserved.

6.4. Refunds are made in the same way the payment was made, within the time limits provided for by the legislation of Ukraine.

7.1. For non-fulfilment or improper fulfilment of the terms of the agreement, the parties bear liability in accordance with the current legislation of Ukraine.

7.2. The Seller guarantees that the drinking water complies with sanitary norms and quality standards, as confirmed by production documents.

7.3. The parties are released from liability for partial or full non-fulfilment of obligations if it is caused by circumstances of force majeure that arose after the conclusion of the agreement.

7.4. All disputes are resolved through negotiations, and if no agreement is reached — in the manner established by the legislation of Ukraine.

8.1. By placing an order, the Buyer consents to the processing of their personal data in accordance with the Law of Ukraine “On Personal Data Protection”.

8.2. The scope of the data, the purpose of its processing and the Buyer’s rights are described in the Privacy Policy, which is an integral part of this agreement.
